Mr. Gomez, No one thinks the Filipinos are second class citizens. A person is only a second class if he or she thinks so.
As I understand, it in accordance to the Philippine-U.S. pact, LCPL Smith is to be kept under U.S. custody until all appeals are exhausted. Don't worry, Sir, once Smith is turned over to the Philippine authorities you'll have your justice. Smith will be lucky if he stays alive for six months under the watch of his Philippine jail keepers for "raping" what many people think was a "loose" woman.
In order to prevent future incidents of this type, it would be wise for the U.S. military authorities not to allow its personnel live in the Philippines. The action of a few bad apples casts a bad light on all the U.S. military and also allows a few Filipinos with a grudge against the U.S. to turn an entire country against the visiting force.
