The answer to your Question no.1 had been answered by Jesus Christ himself when he died for the many. We cannot use our limited knowledge to answer why this is so. What is important is to follow what God has required of us, "without shedding of blood, there is no remission of sin" from which Jesus, as a man, had to also comply.

If you erase Death Penalty, has God left us any other way to attain forgiveness of our sins? Wasn't that the same God who said an eye for an eye and tooth for a tooth? Has God now changed through the Catholic's belief?
